These Terms of Service ("Terms") govern your use of AirdriftSignals at airdriftsignals.com, including its articles, comments, Discussion Board, messaging, notifications and paid memberships (together, the "Service"). The Service is operated by Stefan Walczak, doing business as Appy Solutions ("AirdriftSignals," "we," "us"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Who can use AirdriftSignals
You must be at least 13 years old to create an account or post. To buy a paid membership, you must be at least 18, or have permission from a parent or guardian who agrees to these Terms on your behalf.
2. Your account
- You sign in with your Google account. You're responsible for keeping that account secure and for activity that happens under it.
- You choose a username when you first sign in. Usernames can't impersonate other people, brands or AirdriftSignals staff, and can't be offensive. We may change or remove a username that breaks these rules.
- Some profile features, such as flair, username colors and symbols, depend on your membership tier or on recognition we give, like Featured Artist and Featured Writer.
3. Community rules
AirdriftSignals is a place to talk about music. When you post, comment, react or message, you agree not to:
- harass, threaten, bully or demean anyone, or post hate speech targeting people for who they are;
- post sexual content involving minors, sexually explicit material, graphic violence, or content that promotes self-harm;
- spam, advertise without permission, or post scams, phishing or malicious links;
- share other people's private information;
- post content that infringes someone else's copyright, trademark or other rights;
- impersonate others or misrepresent your connection to a person, artist or organization;
- try to break, overload, scrape or get around the security or access rules of the Service.
4. Your content
You keep ownership of what you post. By posting on AirdriftSignals, you give us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce and distribute it as part of running and promoting the Service. This includes showing it on the site and in notification emails. This license ends when your content is deleted, except where it has been shared by others or is kept as required by law.
You are responsible for what you post, and you confirm you have the right to post it. Your comments are public; see the Privacy Policy.
5. Moderation
We, and moderators we appoint, may review, filter, hide, edit or remove any content, and may warn, restrict or ban any account. We may do this at our discretion, including when we believe content or behavior breaks these Terms or harms the community. Some comments may be held for review by our spam filter before they appear. You can report content using the report tools on the site. We're not obligated to monitor everything posted and aren't responsible for content posted by users.
6. Paid memberships
Plans and billing
AirdriftSignals offers optional monthly memberships, such as Supporter, Subscriber, Member and Collector, at the prices shown on the site when you join. Memberships are billed monthly in advance through Stripe and renew automatically each month until you cancel. Prices are in US dollars unless shown otherwise. Applicable taxes may be added.
Perks
Each plan unlocks the features described on the Membership page, such as flair, reactions, GIFs, poll voting, text formatting and username customization. We may add, change or remove features over time. If we raise a price, we'll give you notice before it applies to your next billing period.
Canceling
You can cancel anytime from the Membership area of the site, which opens Stripe's secure customer portal. When you cancel, your membership stays active until the end of the period you've already paid for, and then it won't renew. Your paid flair and features end when your membership ends.
Refunds
Payments are non-refundable, including for partial months, except where the law requires otherwise. If you believe you were charged by mistake, contact us at airdriftsignals@gmail.com and we'll look into it.
Bans and memberships
If your account is banned for breaking these Terms, you may lose access to membership features. Any remaining billing will be canceled, and payments already made won't be refunded unless required by law.
Featured Artist and Featured Writer recognition is given by AirdriftSignals and cannot be purchased.
7. Email notifications
If you turn on email notifications, we'll email you about activity involving you and occasional site updates. You can turn them off at any time from your profile or with the unsubscribe link in any email.
8. Third-party services
The Service uses third-party services, including Google (sign-in and hosting), Stripe (payments) and KLIPY (GIF search). Your use of those features is also subject to those providers' terms. We're not responsible for third-party services or for third-party content, such as GIFs or links posted by users.
9. Our content
AirdriftSignals' articles, reviews, interviews, design, logos and other original material belong to AirdriftSignals or its contributors and are protected by copyright and trademark law. You may share links to our content. You may not copy or republish it without permission, except as allowed by law. Music, artwork and other material belonging to artists and labels remain the property of their owners.
10. Copyright complaints
If you believe something on AirdriftSignals infringes your copyright, email airdriftsignals@gmail.com with:
- a description of the work;
- the link to the material;
- your contact information;
- a statement that you have a good-faith belief the use isn't authorized;
- a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner.
We'll respond to valid notices and may remove the material and disable repeat infringers' accounts.
11. Ending your use
You may stop using the Service at any time and ask us to delete your account, as described in the Privacy Policy. We may suspend or end your access at any time if you break these Terms, or if we stop offering the Service. Sections that by their nature should survive termination will survive, including your content license for content that remains, the disclaimers and the limits on liability.
12. Disclaimers
The Service is provided "as is" and "as available." We don't promise that it will always be available, error-free or secure, or that content posted by users is accurate. Opinions in comments belong to the people who post them. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent allowed by law:
- AirdriftSignals and its operator won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service.
- Our total liability for any claim relating to the Service won't exceed the greater of the amount you paid us in the 12 months before the claim or US $20.
Some places don't allow these limits, so they may not fully apply to you.
14. Indemnity
You agree to defend and hold harmless AirdriftSignals and its operator from claims, losses and expenses, including reasonable legal fees, that arise from content you post or from your violation of these Terms.
15. Governing law
These Terms are governed by the laws of the State of [YOUR STATE], USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in that state, unless the law where you live gives you the right to bring a claim locally.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date above. For significant changes, we'll also post a notice on the site. Continuing to use the Service after changes take effect means you accept the updated Terms.
